Judge Kettle and Mr Jellicoe.
O M In Banco at Wellington on Wednesday, before the Chief Justice, Mr Jellicoe moved to make absolute a rule nisi granted by tbe Chief Justice in December, 1891, calling upon District Judge Kettle to show cause why a writ of certiorari removing into the Supreme Court (so that it might be quashed) an order whereby Mr Jellicoe was .fined £10 for sending the following telegram to the Clerk of the Court at Palmerstou North: "Re Tapper. Make no mistake. The hearing of the petition was by consent taken yesterday, and adjourned. No further procedings should issue vending result of decision. Hold you personally responsible for further irregularities.—(Signed) Jellicoe." Tbe grounds of the present motion were (1) that the conviction was made without jurisdiction : (2) that it is bad on its tace, as it does not disclose an offence punishable as a contempt, and does not Bet forth the evidence of adjudication, or . examination of witnesses on oath in the
