Breaches of the Bankruptcy Act.
At the Palmerston Police Court yesterdoy the following case was dealt with :— C. A. Kendrick was charged on two informations by G. J. Scott, D.O.A. in Bankruptcy, with (1) contracting a debt with no reasonable expectation of being able to meet the payment; and (2), incurring a debt and obtaining credit under false pretences. The evidence was the same in both cases. Mr Hankms appeared for plaintiff and Mr Innes for the accused. The eyidence for the prosecution was to the effect that at the end of May, 1894, the accused bought from Gorton and Son, auctioneers, some 360 sheep for i'6s on a three months' bill. Accused informed Colonel Gorton that he had property for which he had paid .£BIB, and that there was an encumbrance of £200 on this *■"- land. With the exception of six acres the section was felled and laid down in grass. Colonel Gorton entered these particulars in a memorandum book, which be kept specially for the purpose, and the accused added his signature. In November last, accused became bankrupt, and in his public examination admitted that he had no property of any account and was leasing the section in question under a purchasing clause. . : His Worship dismissed the first information, and convicted the accused on the second information and sentenced him to three months' imprisonment in Wanganui GaolMr Innes applied for the release of the prisoner on probation. Mr Hankins said he had no objection, and the case was adjourned ti!l next Friday to entible the Probation Officer to prepare his ropoit, The accused was released till Friday on bail. — Standard.
