THIS DAY. | (Before Messrs A. F. Halcombe and C. J Bull, J.P.'s.) I A. K. Blundell v. Gh Burnett. This ; was an information laid by the Inspector ; of Sheep against defendant for exposing sheep effected with lice in a public sale- j yard. Mr Sandilands appeared for defendant, who pleaded guilty. Conyicted and fined £1 with costs 7s. Feilding Borough Council v. H. V. Pickering; claim £5 2s 8d for rates. Mr G. C. Hill, Town Clerk, appeared for the Council. Judgment for amount claimed, with costs 10s. A. R. Allan and Co. v. R. Somerville ; a judgment summons, claim £1 13s 9d. Mr Reade for plaintiff, Ordered to be paid within 14 days, or, in default, three days' imprisonment in Wanganui Gaol. G. Stewart v. E. Barrett; claim £3 16s. Mr Reade for plaintiff, and Mr Sandilands for defendant. This was the re-hearing of a case, judgment having been given at a previous sitting of the Court for plaintiff, as defendant was not present. G. Stewart, deposed : Was a laborer ; took a fencing contract from defendant about March or April last ; the contract was for 51 chains of fencing at 12s 6d. Barrett agreed to supply the material on the ground ; there was no wire on the ground, and witness drew defendant's attention ; carried the wire himself from the house to the work, a distance of about a mile ; it took at least 40 hours to carry the wire to the job, and claimed ls an hour for this ; arranged with Barrett to purchase mutton from him at 2§d per lb ; 3211bs was overcharged at £d per lb ; after the contract was completed worked for defendant for 21 days, for which he was allowed 6s a day and he claimed 7s ; defendant supplied him with tools, and charged him for them, promising to take them back on completion of the work ; took another contract from defendant, who stopped witness when about one acre of scrubbing had been done ; defendant agreed to graze a horse free of charge. Cross-examined : Cut the fencing timber where he could and conveyed it to the fencing line ; the charge of 25s represents the whole of the charge for loss of time in carrying the wire ; did not keep a book to show the time he worked, and the loss of time was merely a guess ; during the time he was working for defendant was suffering with rheumatism and could not work regularly ; understood he was to be paid by the day after he completed the fencing ; was lent tools and cooking utensils by defendant ; was to fell the bush at 33s an acre, and claimed 10s for the one acre underscrubbed ; gave up the bushfelling as he thought he wouldn't get paid for it ; Barrett wanted 3d for the mutton when they were making the arrangement, but witness refused to give it, and did not notice in the settling that he had been charged 3d. Edwin Barrett, deposed : Employed plaintiff to do fencing ; did not agree to place wire on the site ; refused to let plaintiff have the meat at less than 3d a pound ; in the settling up plaintiff told witness that he would sue for the difference between the 6s and 7s a day for twenty-one days work. Judgment for 10s for the underscrubbing, with costs 6s. Susanah Woodhead v. Bergersen ; claim 14s. No appearance of defendant. Judgment for amount claimed. S. S. Ratliff v. J. D. Valentine ; claim £2 Bs. Mr Saudilands for plaintiff and Mr Reade for defendant. S. S. Ratliff deposed : Acted as agent for Mr G. J. Scott, D.0.A., in the bankrupt estate of J. D. Valentine ; collected rent from Valentine on behalf of the D.O.A. and the supervisors in the estate ; witness bought the property and allowed Valentine to continue for one month, when witness went to collect rent defendant told witness that Mr Reade had advised him not to pay him ; no notice had been given when defendant left the house. Cross-examined : On September 20th purchased the property; charged for rent from September 17th and Valentine left on October 15th ; Valentine promised to pay witness the rent. Mr Reade submitted the defence was that defendant was an uncertificated bankrupt and no notice had been sent to defendant that the property had been transferred to Ratliff. He also submitted that if any rent was due it was due to Mr Scott. He admitted that three weeks rent was due. J. D. Valentine deposed : After his insolvency leased the house from the supervisors in the estate ; never agreed to pay the rent to Ratliff ; owed the D.0.A., Mr Scott, for three weeks rent. Cross-examined : Gave Mr Ratliff notice he was going to leave the house a few days before he left ; Mr Scott had never made a claim to witness for the rent except through Mr Ratliff ; was willing to pay for three weeks rent, but to Mr Scott. Judgment for the amount claimed with costs 5s and solicitor's fee £1 6. An information was laid against G. Turnbull by A. K. Blundell, sheep inspector, for having exposed for sale sheep affected with lice. Accused pleaded guilty and was fined .£1 with costs 7s. Ranson and Son v. C Cotterill. A judgment summons claim .£l9 5s lid. Mr Reade appeared for plaintiff. , Defendant was put in the box aud swore that he was not in a position to pay the amount. Adjourned for three months on the application of plaintiff. [Left Sitting.]
