I i i Q | (Per Press Association). Wellington, October 30. In the Appeal Oourt the case of McKensie v. Hogg is being argued. This is an appeal from Justice Williams in the Clutba licensing case. The question involved is whethor section 23 of the Alcoholic Liquors Sale Control Bill, 1893, applied to wholesale licenses and prevents the issue of any new wholesale licenses except upon an increase iv population iv any district as mentioned in the section. The poll in Clutha was against the granting of any publicans' licenses and therefore applications were made to Mr Hawkins, S.M., as Chairman of the Committee for three wholesale liceußes. There had previously been no wholesale licenses in the district. Ho granted the applications, and proceedings were taken to obtain a writ to quash the licenses, aud Jutice Williams granted tho writ, holding that section 14 applied. _ •
