AN IMPORTANT LICENSING CASE (Per Press Association) Wellington, October 19 The case of Ebrenfreid and another v. Kenny and others is proceeding. This is an appeal from a decision of Justice Connolly, refusing a mandamus to the Thames Licensing Committee to grant a license in respect of the Empire Hotel. at the Thames. The appellants are the owner and the late licensee of the hotel, and respondent members of the Licensing Committee. The poll re licenses at the election early in the year was void. The Committee refused a license to the Empire Hotei at its first meeting. The contention for the appellants is that the poll being void all existing licenses must be renewed, though they could be cancelled afterwards for a good cause. It is also contended that on the facts the committee has exercised no discretion, and there was no ground for the refusal. The case is being heard before the Chief Justice and Judges Richmond, Williams, Denniston and Connolly. Argument for the appellants was adjourned to Monday j morning. ________________
