Mr Sandilands for plaintiff . Judgment for amount claimed with costs 10s, solicitor's fee ss. The Trade Company of N.Z. v Maurice Drury ; claim £ 1 Is. Mr Prior for defendant. This was a case in which the evidence of defendant was to be taken, the summons being issued from Christchurch. Maurice Drury deposed : At one time subscribed to the Bankruptcy Gazette ; gave notice in writing cancelling order ; there was at one time a dispute between witness and Company as to the amount due ; paid their agent 11s 6d and received a receipt (produced) ; this receipt was given acknowledging full settlement of the claim. J. Purkiss vJ. Lukaschwaski ; claim _4 17s. Mr Prior for plaintiff. Judgment for amount claimed with cost 11s, solicitor's fee ss. ASSAULT CASE. Albert Edward Bull v. Jane Loader. This was a charge laid by plaintiff for assault at Campbelltown on the evening of October 10th. Defendant pleaded guilty to striking plaintiff with a stock whip but pleaded justification. Albert Edward Bull deposed : Was the owner of a cottage occupied by Mr and Mrs Loader ; served Mr Loader with a notice to quit on the night October 10th, was in Mr Verry's boot shop ; George and Jim Marshall were present; Mrs Loader came in and said " You're just the man I'm looking for " ; she asked him to withdraw the lawyer's letter but refused to do so ; Mrs Loader then " laid into " him striking him about the head with a stock whip ; was afraid the offence would be repeated. Cross-examined by defendant : There were three weeks rent due ; never made use of insulting language to defendant. Examined by Mr Reade : The incident about the horse took place on witness' property where it could not be seen by the public. George Verry deposed: Plaintiff was in witness' shop when Mrs Loader came in ; defendant struck plaintiff several times with a whip. Examined by Mrs Loader; Remembered that ou Octobpr Ist plaintiff said if defendant's husband made a fuss about the horse he (plaintiff) would turn defendant out of the bouse. By the Bench : Defendant was not present. George Marshall gave corroborative evidence. Jane Loader, deposed: She was a married woman residing at Campbelltown ; on a Sunday three or four weeks ago plaintiff made use of insulting language; referring to the incident of tbo horse, plaintiff made use of the expression "If 'the old b will make a fuss about it he would turn them out of the house;" witness could not got redress by law, aud then took the law in her own hands and horsewhipped plaintiff. Wm. Hogg gave evidence of assault. Cross-examined : Plaintiff did not retaliate but asked for more. Richard Loader deposed to having a conversation with plaintiff warning him qf his conduct ; spoke to plaintiff about the language 'he' jiad."uHed to witness' wife, Mr Reade applied to have Mrs leader bound oyer to keep the peace. His Worship said it did not appear to him that auy great offence had been committed, but defendant should not have acted as she did. It appeared to be a case for the police to enquire into re the horse. The provocation seems to have been the sending of tho lawyer's letter. Considering the fact that the husbapd approved of his wife's action he would order the wife to find pup surety at .£lO to keep the peace for six months, No expenses were allowed. The husband's recognisance was accepted. The Court then adjourned.
