A Peculiar Case.

Christchubch, August 6 A rather peculiar case came before ' the Stipendiary Magistrate to-day. ■ Margaret Pobar made an application •gainst her husband, Francis Pobar, to compel htm to pay arrears of maintenance, amounting to £6 10s due on an order made under the Destitute Persons Act, 1887. It appeared from the evidence that after the order had been in force some time defendant instituted divorce proceedings against his wife, and on June he obtained a decree nisi. Up to that date defendant had paid all arrears of maintenance, and the applicant now sought to make him pay arrears, which had occurred since June 4th, on the ground that until the decree was made absolute she still retained the status of a married woman. Applicant admitted that she was receiving Bs, and her board and lodging. The Magistrate therefore ruled that she was not a destitute peraoa within the meaning of the Act, and declined to enforce the order.
