Elmer-, an application by the wife for judical separation on the ground* of adultery, came up for hearing Respondent, who is a farmer at Tai Tapu admitted the adulter?, but pleaded that by a deed of separation concluded in 1886 petitioner, in consideration of the sum of £1300, compromised the proceeding then instituted for judical separation. After argument, his Honor said that he was inclined to think that the contract conniving at adultery might be roid, and that if it were tbe deed would probably not be a bar to action. He thought, however, that underthe circumstances it would not be right for him to giye a decision on the matter dow.^^^^^^^
