Bicycle v. Buggy.
(PEK NtEM ASSOCIATION.) I>VEBCABGiLt, May 29. In giving judgment in the cycling case Blackie v. Nisbet and otherß, claim £40 for injuries sustained in consequence of the contravention of the Southland Conuty Oouncil bye 1 iws le pairing bicyclists to dismount twenty yards from an approaching horse, and by which the plaintiff was thrown from his buggy, the Magistrate, Mr Rawson, held the bye-law unnecessarily restrictive of the common law right and oppressive, and therefore ultra vires, and also expressed the opinion that the defendants had not been guilty of culpable negligence, and gave judgment in their favour with costs JCo 19s.
