W. Cox's Choice, 1 ; Curzoo 2 ; Saintly, 3 Wellington. May 8 The case of D O'Hrien V. G G. Stead is being areued in tbe Court of Appeal to day. Tbe appeal is from the decision of Justice Denuiston. and the question is whether on contraction of the programme of - the first Challenge Stakes by tbe Canterbury Jockey t'lub. of which re spondent is treasurer, appellant, as the owner of Loyalty, is entitled to any surplus of Stakes and forfeits over and above 2,000 soys, less the amounts pay able out of the stakes to others.
