Important Decision.
[PKB PBBSB ASSOCIATION.] Wellington. April 30. An important point was decided by Mr Martin, S.M., in the Magistrate's Court to-day affecting incorporated companies trading in New Zealand. Tke case was one in which Birnbaum and Co., Ltd., water-proof manufacturers, of London, Melbourne and Wellington, sued G. W. Smart, pawn- j broker, Wellington, for j£3o, being the value of water-proof coats, etc., pawned sometime ago by Mr Birnbaum, junr., then the local manager for the company. It was contended by Mr Skerrett that the case must fall through, as the power of attorney, en powering Messrs Peters and Birnbaum, junr., when the goods referred to were pawned, was void, Mr Birnbautn having left the colony without his power or attorney having been delegated to his successor. This objection Mr Martin held to be fatal to the plaintiffs.
