Mr Reade for plaintiff. Judgment for amount claimed with costs 6a. J. Darragh v J. W. Brown ; a judgment summons, claim iill 7fi. Mr Prior for plaintiff. Ordered to be paid at the rate of 19s per month, the first payment to be paid one month from date. C. Matthews v Rnera To Nukn ; a judgment summons, claim £5 Is 9s. In default of defendant's attendance the claim was ordered to be paid within one month, in default a week's imprisonment. R. Parr v W. Baker ; claim £1 14s. Mr Reade for plaintiff and Mr Prior (acting on behalf of Mr Sandilands) for defendant. This case, partly heard last Court day, was a dispute as to the ownership of a dog. After hearing the defendant's evidence, judgment was given for plaintiff for amount claimed and costs 15s, witnesses' expenses 20s. W, F. March v W. Franklin -Browne ; claim .£ls. Mr Richmond for plaintiff, and Mr Prior for defendant. W. F. Marsh deposed : He was a contractor, residing at Apiti, and had received a cheque (payable to Mr Lowes) drawn by Mr Franklin-Browne, and on being presented at the bank was dishonored : the choqno was received from Mr John Madden. Cross-examined : Received the cheque from John Madden ; knew him for about three years ; Madden worked for witness at different times, and paid him last night up to the previous night ; made no deduction for the previous cheque ; cashed the cheque and did not ask Madden at the time where he got it from; it did not seem strange that Madden should bring a cheque payable to Lowes, seeing that witness knew Madden ; thought the cheque was " good enough " whgn he cashed it. H. B. Dyer, of the Bank of Australasia, deposed that the cheque in question was presented for payment, and it was endorsed as " signature unlike" ; it was treated in the ordinary way as a dishonored cheque. Wni. Franklin-Browne deposed : Had built a shop at Rangiwahia; the contractor, Mr J. Check, asked to be paid in cash ; witness was unable to get cash in Feilding, as he was leaving before tho banks were open; wrote out a cheque in favor of Mr Lowes, whom he asked to cash the cheque, but lie could not do so ; at Rangiwahia asked Mr Mclllroy to cash it, but he could not ; wrote another cheque, this time in favor of Mr Check, for £15 10s ; was under the impression he had torn the first cheque up with other letters ; the first intimation he had that ihe cheque was lout was the clerk going to witness to ask if the signature was correct ; witness then instructed the bank not to cash the cheque. The case was nonsuited, with solicitor's fee £1 Is.
