An Interesting Bank Case
Joseph Marsh, a grocer, of Melbourne, recovered £60 damages from the Bank of Australasia owing to that institution dishonoring two cheques. It appeared from the evidence thnt plaintiff gave two small cheques drawn by him on the bank in payment of eccounts in the ordinary course of business. On the same day he gave a cheque for £9 2«, which was post dated to the following Monday. Bj mistake the post dated cheque was presented the sunie day and cashed by the defendant bnnk,' and in consequence of this erroneous payment there was not sufficient money left at credit of plaintiff's account to meet the two other cheques when they were presented. They were accordingly dishonoured, the result being that plaintiff suflered considerably in his credit.
