Important Bankruptcy Case

His Honor the District Judge, Mr C. C. Kettle, yesterday gare judgment in the cane brouuht by the Official Assignee, of Palmentton, in connection with the bankruptcy of Wilheim Christensen. of Jnckejtown. Paltnorston North. The bankrupt filed on 7ihof November, 1H92. A few months before filing l'»c bankrupt transferred jeel'On 21, Block IX , Pohnngmn district, to his wife in exchange for section 7? of the name block, which last section it wni alleged was his wifc'is property. On the 27th of September of the same jrar the bankrupt sold to his wife fire horaes and a draj tor a sum of money which wat paid to the bankrupt. His Honor held that he was not justi* fted on the efideoce in finding that the ' exchange (*ection 21 for section 771 was fraudulent and void under the Statute of Elisabeth or under the Bankruptcy Acts, but that the arrangement between the bankrupt and his wife, whereby the latter received LSOO, oo the sale of section 21 with the other sections belonging to the bankrupt was not a bonajfid-t arrangement, but wat made colluaively in contemplation of bankruptcy and with a view to defrauding Curuten*en'«( credi tor* to the extent of L2OO, and to that extent the payment must be declared fraudulent and voiJ, and Mrs Christen* sen ordered to refund L2OQ of the purchase money to the Assignee forthwith.
