An Important Judgment

(l'Ell THKSS ASSOCIATION.) Palmekston PC, This Day. At tho R.M. Court to-day Mr Brabant gave judgment in a case of considerable importance to local bodies and contract* ors. John Carmody, contractor, claimed from the Fitzherbert Road Board £11 2s 6d for the construction of a bridge in place of a culvert, as shown by specifica* tions. It was admitted the Engineer to the Board had authorised tho work, and had also given a certificate but Mr Hankins, for tho defence, raised several law points. The grounds of the defence were thattheEngineer had no power to authorise tho extra work provided for in the specifications ; that tho bridge was not worth the amount claimed. The R.M. said in law he must give a judgment for the Board on all the points raised, but in fairness the Board should pay a (reason* able amount towards the work done. The plaintiff was non-suited, each party to pay their own costs.
