Mr Justice Windeyer considered Mr Justice Williams, of Dunedin, was right in admitting evidence which the Supreme Court of New Zealand declared iuadtmssable, as, viewed in the light of a science and com mon s j nse, there was a nexus between the death of Captain Cain and the illness of Mrs Hall; and the exclusion of any evidence which would show such a con ncction could only be regarded as erroneous.
