Feilding R.M. Court
> TnURSDAY, FEDIIUAItY 2ND. (Before Mr. Brabant, R.M.) The following cases were heatd after we went to press on Thursday : — William Chirm v Samuel Daw, (concluded). Wilham McKeague gave evidence for the plaintiff. His Worship, in delivering judgment, said that much time had been spent in going mto the defendant's books. The burden lays on the employers to prove that wages have from time to time been paid, aud the accouut appears to have gone en for some considerable period, although the plaintiff frequently applied for a settlement. The Court could not pay much reliance on the defendant's books, neither could it do so in respect to the book kept by Chiuu. Nothing can be made from the entries in the defend* ant's books, and the servant must have the benefit of tbe doubt. J-udgmeot would be for plaintiff for the sum of £9 15.-5 in addition to the £6 15s paid into court, with 18s costs, 16s expenses of witnesses, and 21s solicitor's fee De fendant was allowed one week in which to pay the money. A. L. Parr v Penihira ; claim £1 lis. Mr Reade for the plaintiff. The defendant disputed some items in the account, and had offered plaintiff 15s in his shop in settlement of the account, but the latter declined to accept this sum. Judgment was for the plaintiff for the sum of 14s 6d, with costs of cpurt 9s, interpreter's fee 10s 6d, E. Cornwall y W. C. Boyd ; claim £13 18s 6d. Mr Richmond for the plaintiff. Judgment for the plaintiff, by arrangement, for tbe sum of £10 19s, with lOs costs of court, and 21s counsel's fee, this amount to be paid in 14 days time. W.
