In their haste to avail themselves of the Local Bodies Loans, and the Government Loans to Local Bodies Acts the astute members of the Pohangina Road Board have made an oversight which may somewhat delay the accomplishment of their wishes. The mode to follow to meet the requirements of these Acts is as follows: — The first step is to make a Special Order under Clause 3 of the Local Bodies Loans Act which order is valid as soon as it appears in the Government Gazette, but not before, as provided for in Clause 76 of the Road Boards Act 1882. Now as this i Special Order waß only confirmed at the last meeting of the Board it canj not possibly be Gazetted until next Thursday. Without waiting for the completion of this very important part lof the necessary proceedings, the [ Board have advertised their schedules I of proposed works, held their meetings of ratepayers, and appointed days for taking the polls before the Act under which they propose raising the loans was in force so far as they were concerned. Of course this may be merely a legal technicality which can be met by an Order in Council, but at the same time it shows that the members of the new Board are not well posted in the laws under which they are expected to work.
