Guthrie ; claim £6 for rent due. Mr Prior for the plaintiff stated that he had served the defendant with notice to leave the house which he at present rents from Mr Mountford, but the defendant declined to go out as he could not obtain another house. Order made for the defendant to give up posssesion of the house in 14 days time, £d 12s tb be paid forthwith, the balance within two months. A. L. Parr v A. J. Gibson ; claim £26 6s 9d. Mr Sandilands for the plaintiff. Judgment for plaintiff for amount claimed with costs 30s, and solicitor's fee, £2 12s. J. C. Morey and Co. v W. Spooner ; claim £2 Os lOd. Mr Prior for the plaintiff. This case was partly heard last Court day, and was adjourned to allow of a Mrs Crook giving evidence for the defendant. Hannah Crook deposed that she kept house for W. Spooner in January last, and ordered goods as required for the household. Witness bought goods in December and January for tbe defendant, which were for the defendant and his son. Judgment for the amount claimed and costs 9s G. Mc Bride v D. Sanson; claim, £2 12s 6d. Mr Prior for the plaintiff. Mr Whitehead, traveller for plaintiff, a merchant tailor in Auckland, proved the case. Judgment for the amount claimed with costs 18s. George Dear v Thomas Oliver ; claim £23 15s, made up as follows :— £ls for a reaper and binder ; £4 for hire of two horses for a fortnight, and £4 15s for two improved knotters. Mr Prior for the plaintiff, and Mr Sandilands for the defendant. The plaintiff deposed that he sold the reaper and binder to the defendant's father, but owing to the latter's death it was not delivered, and the defendant afterwards undertook to buy the binder. In cross-examination by Mr Sandilands, the plaintiff denied ever promising to lend his father-in-law a reaper and binder to cut his crops; witness did not send his claim in until after the deceasid Mr Oliver's property was vested in the Public Trustee ; witness was annoyed at this step being taken, no sum was fixed as to the price of the binder ; witness has a claim against Mrs Oliver, senr., of £12 10s for money lent to her to pay her rates, but has never sent in any claim to the Public Trustee for this sum ; the witness believed the defendant's contra account for £10 2s 6d was correct. Re-examined by Mr Prior : The contra account produced in Court to-day had not ! been presented previously. James Bowater deposed to supplying Mr Dear with two knotters in December, last at a cost of £4 15s. Henry Stewart deposed that he had repaired the machine in question for Mr Dear. Thomas Oliver stated that his father's property was transferred to him by the Public Trustee at the request of witness' mother and relatives; witness had not made arrangements to buy the reaper, or to hire Dear's horses ; Dear had never applied for a return of the machine which was lent to the defendant. Cross-examined by Mr Prior : Witness never told Dear that the machine suited him very well. Told the latter once or twice to fetch the machine back. Witness considered the borrower ought to return an article. . t , By the Bench. Witness understood that the machine was lent to his father. Edward Jackman, deposed to being present outside Awahuri Hotel, one sale day, when Dear and Oliver were present. Witness offered to cut Oliver's crop, but the latter stated he had arranged for Dear to lend him a machine. [Left Sitting.]
