Important Judgment
Mr Justice Richmond gave judgment in an action at Wellington wherein a" tied " public house figured prominently. The plaintiff had bought the hotel from Staples and Co., brewers, and gave a bill-ot-sale and mortgage as security, wherein it was stipulated that he should #ci, colonial beer from the defendants. He paid off the debt and demanded a release, but defendants contended that payment did not release him from the bond to deal with them only, as, though the bill-ot-sale convenaat applied only to the continuance aftbre security t in the mortgage, it -"was not so stipulated. His Htfnor commented strongly on th^p'ractice of inserting _GoUateral~advantages in such insure ~"" ments, and said the Registrars ought to refuse to receive them. The security having been released, the covenant was at an end, and he gave judgment ior the plaintiff with costs. His Honor said that it was open to argument whether such a contract was not legally void.
