The defendant slated that he held alB months : l&se of the Bailfray Hotel from Mr (JiobpuS i who had power' to cancel his lease by payment of £100 compensation ; on beingappiied; to by the plaintiff as to whether he woWd'sell the goodwill of the lease 5-1* replied that he would do so for £75, and that lf-fche plaintiff could negotiate a sale he could retain any sum above that amount; ttie price of £100 was not mentioned; he made no arrangement with the plain&ff/ad to the sale of the stock and furniture; he had received no application from the plaintiff for a commission on the sale, which was afterwards effected ; the greater part of the *u».iture had been rented by him from Mr Gibbons and was not sold! < ■' ■ ■ • By Mr Sandilands : He did not know why £3 15s had been paid into Court ; he had not given notice to the plaintiff that he was about to arrange a sale .on his own behalf before concludipg the bargain with Mr Speight His Wo&hip having taken tun* to consicter tfte case, gave judgment for the plaintiff for five per cent on the whole purchase money, namely £17 os on Ldio, and £5 4s costs/ v t • B. Wrightapn V D. Amesbury ; claim, £8 6s 6d/on a judgment summons. , Mr Sandilands for plaintiff,- and Mr Bichmond for the defendant. Mr Sandilands = that the defendauthadpaid half tfco amount of the original claim into Court, Wjith the object of inducing his creditors to; accept 10s in the pound; the defendant was in receipt of regular payments from Home and was well able-to pay bis debts. - _ .; His Worship said the defendant should have been present.-and-made an order for the amount to; be paid' within two months with 10s cost., or in default the defendant to suffer lo; days imprisonment. The Court then adjourned.
