Mr J. McKelvie's Will

The will ot the late Mr John M'Kelvie was made on the 27th November, 1887, the trustees, being M essrs Arthur Amon (testator's brother-in-law), John Hammond, John Stevens, and W. H. Levin. This will bequeathed to testator's wife all the household effects, plate, &c. ; to his brother. James M'Kelvie brewer, oi Nottingham, a sum of £1000, and to two neices, Maggie Rutherford and Jeanie Kutherfbnl, £500 each The Rangitikei estate and stock was to be held in trun, and out of the income the trustees were directed to pay Mrs M'Kelvie £100 per ancum for the maintenance and education of each of testator's children while they were minors and remained with their mother ; LIOO per annum to each son on his attaining the age of 21 years, and until he had reached 25, and to provite such sums as the trustees thougbt fit for the maintenance and education of such of testator's children as were minors but not living with his wife. The trustees were also authorised to increase the incomes payable to the sons should they see fit, if they desired to travel before taking possession of their properties. As soon as testator's sou. James Flockhart M'Kelvie, attained the age of 25, the portion of the Rangitikei station easj; of the Rangitike river, one-half of the stock, and £300 in cash, wa4 to be held in trust, for him. On testator's son . Lynne Rutherford M'Kelyie attaining 25 years of age; the part of Rapgitikei stanion west of tie .Rangitikei rjver, together witH the stock thereof and a sum of £500 were to be held in trust for him. Should either die before, attaining - this age, the properties mentioned were to be considered part of the residue of the estate, which was to be converted, invested, and held " J in trust, and the interest allowed Jtp accumulate. From this trust the .testator willed that LSOUO should be.set apart for each of his daughters '.'.(except his daughter Edith, already " "provided for) on their marrying or attaining the age of 21, the income ' attine to be payable to them. So soph as the youngest surviving daughter'attained the age ot 21 years, the balance of the trust fund was to be equally divided amongst,, all of testator's children then living-, or their issue if dead. In a codicil, dated 7th June,. 1889. the legacies to Magpie Rutherford and Jennie Rutherford were revoked, the testator setting out that he had made other prDvision for them. In a codicil, dated IBth September, 1890, James Flockhart M'Kelvie was substituted as trustee for John Stevens. A third codicil dated 7th October, 1891, set out that testator's daughter Esther, having been otherwise proTided for by settling on her certain land in the Rangatira Block, she was no longer emitted to her LSOOO under the will.
