Feilding R.M. Court
Monday, March 7. (Before Messrs Sherwill & Kirton, J.P.s) J. H. Blackmore, v. F. Hewitt. This was a charge of rescuing a horse while in charge of the Eanger. Mr Prior, who appeared for the informant, called Gr. C. Hill, Town Clerk, who produced evidence of the appointment of J. H. Blackmore as Eanger and Poundkeeper. J. H. Blackmore deposed to securing a horse that was tethered in Denbigh street on the 28th July ; defendant liberated the horse from the tether rope, exclaiming, " You may drive a horse to the pound but you cannot lead ifc." Rebecca Rugstead gave evidence to the fact of plaintiff having charge of the horse | at the time stated. Defendant, who conducted his own case, was then sworn and gave evidence as to the manner of liberating the horse, his object being to prevent it being led to the pound by means of his own rope ; he did not deny the offence, but submitted that his act was quite lawful. Duncan Macintosh gave corroborative i evidence for the defendant. Mr Prior read extracts from the " Impounding Act," which showed that an animal might be driven, led, or conveyed to the pound, and on these grounds asked for judgment. The accused was find 10s, costs 9s, and solicitor's fee 1 guinea, to be paid in 14 days.
