Meeting of Creditors
The first meeting of creditors in the bankruptcy estate of Mrs Viola Evans, storekeeper, was held at the Court House yesterday afternoon. The D.0.A., Mr Scott, in the chair. The following creditors were present : — Mrs Hastia (proxy W. A. Sandilands), £39 2s ; John Marshall, £1 4s ; J. Phillips, £5 6s sd ; W. Carthew, £1 19s ; S. J. Thompson, £3 7s ; Bichards and Co., i! 37s 6d. The debtor put in the following statement: — Unreserved creditors, J6230 5s lid. Estimated value of stock in trade, ; book debts, i>27 7s Od ; estimated to produce ; furniture, £20 , cash in hand, nil ; deficiency, ±154 5s lid. The following is a list of creditors and the amounts : — Aulesbrook and Co., L 44 14s ; Patterson, Michael, and Co., Ll6 17s 4d ; Hatnck and Co,, Ll9 Is lid ; T. and W. Young, LlB 4s 6d ; G. H. Thornton, Lls 18s ; Nelson Moate and Co., Ll3 ; Hart and Co., L 10; W. Summers, Lls ss; Thornton and Lewes, L 5 12s; A. D. Willis, L5 4s 9d; Townsend and Paul, L 4 19s 9d ; S. J. Thompson, L 3 7s ; J. Pollock, L5; J. H. Worsfold, L 3 10s ; Mrs McKeague, L3 ; J. Phillips, L5; Fletcher and Humphries, L5 3s lid ; J. Gooden, L 5 13s 9d; W, Carthew, LI 19s ; Richards and Co., L 2 3s ; W. Fergusson, L 2 12s ;M. Hastie, L2O 8s ; Kirton and Curtis, LI 19s 6d; H. Wollerman, L 2 10s. The D.O.A. said that Mr Haybittlehad yalued the stock in trade at L 34 19s 6d, but he did not think it would realise at auction more than about L2O. The preferential claim for rent was Ll3 12s, and there the legal costs, which would leaye next to nothing for the creditors. Mr Prior, for the bankrupt, stated the cause of her filing to be pressure by several of her creditors. Mrs Evans said she began business in November, 1889, having no money to start with ; her husband, took ill in February, 1891, and died in April. The D.O.A. said the objection the merchants had was the large amount of debt Mrs Evans had incurred in so short a time, leaving no assets, although he expressed yery little sympathy with merchants in such cases. Mr Sandilands proposed, and Mr Phillips seconded, That Mrs Evans be ( allowed to retain her furniture, and that the creditors do not consider a public examination necessary. Mr Richards expressed some dissatisfaction with the bankruptcy, and instanced some transaction he considered not quite right. Mr Prior said if the debtor, had been a man Mr Richards would not have gone into her shop and said what he did with reference to the transaction between them. In reply to a question, Mrs Eyans stated what Mr Richards said. • Mr Richards still said he was not satisfied with the bankrupt's dealings, but eventually he waived his objection and voted with the motion, which was carried unanimously, and the meeting was then declared closed.
