Lyttblton, February 2In the Akaroa' petition the Court found there had been irregularity by ten out of ■eleven booths, hot: being ..closed till 7 o'clock or ah hour after the time they ■should have been closed, but failed to see that this irregularity affected the election . The majority for ' Joyce was 107, and it did not appear to their honors reasonable possible that the number prevented from recording votes by reason of the irregularity . complained .of was, anything approaching that majority. Their honors came to the conclusion that- the case of petitioner not only failed to show; there was reasonable ground for believing the return of Joyce affected by the irregularity, but they iwere also satisfied there was no' '.reason- to believe that had such irregularity not. occurred the majority for Joyce would have been substantially reduced.' Joyce was thereforeproperly returned:'" Petitioner was ordered 'to pay costs. . ' . *■ •"
