White: In this case an appeal was made against a decision of Mr Justice Denniston, who had decided that the respondent was not responsible for damage caused by a fire started by a contructor on the respondent's land in Canterbury. ' Their Honours .VI r Justice Richmond, Mr Justice Williams, and Mr Justice Oonolly leld that the respondent was liable for the damage done through the act of the contractor, and reversed the decision of the Supreme Court. Their Honours ordered the case to be remitted to the [Resident Magistrate at Katapoi to assess damages against the respondent. Costs were allowed on the lowest scale.
