The ordinary monthly meeting of the above was held as held as above. Present — The Mayor (Dr" Monckton), Crs Haybittle, T.. It. Chamberlan, Lethbridge, Goodbehere, J. C. Thompson, S. J. Thompson, W." Watts, and Rutherford. ~ The minutes of the last ordinary, and a' special meeting, were read and confirmed. correspondence; , From W. D. Nicholas, asking permission to put down a concrete footpath ia front of Messrs Pringle Bros, shop in Fergusson street. From W. Carthew, asking leave for Mr F. Pope to erect scaffolding at. the building now being erected in Manchester street. From F. Train, in reply to an"application to sell a certain section. From 0. Wickham, resigning the position of Borough nightsoil contractor. From G. Fidler, applying for the position of Borough nightman. From the Auditor-General, applying for .£8 16s Bd, costs of auditing the Borovtgb accounts. From the Poundkeeper, reporting he had -handed over £5 lis 6d receipts for the month of November. From the Clerk of Works, estimate of making a cutting through sections 97 and " 98 to. divert the Makino stream. From the Property Tax Commissioner, . re subsidy. . Beport of the Inspector of Nuisances, re I alleged nuisance created by Mr Gillett's flax mill at Makino. From F. Gillett, on the same subject. From Mr "Palmer requesting an interwith the Borough Council. Beport of the Finance Committee authorising payment of accounts, £S& 8s 3d, was adopted. The outward correspondence was then read. From J. Tayloiydeclining to accept the proposal of the' Council re culvert. ' The > half-yearly balance sheet of the Borough was adopted and laid on the table. Mr Palmer, mill manager for Mr Gil- * lett, waited on the Council. He reported he had made dams and taken other steps to prevent the pollution of the Makino stream. • ' In reply to Cr J. C. Thompson,. he said he had seen horses. drink the water in the - Makino stream below the.mill recently. ' In reply to Cr Watts, there was very - little sediment now and the water seemed clear. ■ In reply to Cr S. J Thompson, he said . he could not give the present depth of tho da,m. ' ■ x In reply to the Mayor, he said he. was prepared to adopt at once any suggestions the Council might make. The Clerk of Works reported he thought ' the present dam was very little good, a couple more filter dams might prevent - pollution. There, must always be some -. bitter substance in the water, no matter what was done. Cr Lethbridge said he had .seen horses drinking the water 'from the stream near Mr Turner's. - In reply to Cr Goodbehere, the Clerk of Works said he had noticed "a strong smell . below the dam proceeding from the sediment lyirifr about. He' was satisfied tho water was now- clearer 'than it was before the dam was made.

Cr Lethbridge suggested the . matter might be left to theLispector of Nuisances and Mr Palmer to do what was necessary. •The Mayor said there were several ratepayers who had complained of the-nui-sane froirt the flaxmilla and the Council was bound to protect them. ' He was, however inclined to adopt the suggestion made by Cr Lethbridge. v

Cr Butherford said he bad visited the place in compapy with Cr Goodbehere and ■Mr Bichardson, and they bad found the water perfectly good except in one place up the creek. " The remaining water was quite cle-ir. If a little more jvork were done to the dams be felt sture the nuisance complained of would be entirely abated. The dams seemed to keep the sediment back, as it was' not running with the wafer. ■ Mr Bichardson had remarked to him (Cr' Butherford) that he had not seen the water so clear for some .weeks, as it was at present, Cr Goodbehere said he bad tasted the water, which was perfectly sweet, and although they had tried, they ,could not trace any offensive .smelL The ,dam seemed to have done what wag required of it. 7 Cr S. J. Thompson suggested" that* an analysis might be made of the water to see the effect the deleterious matter had on men and animals. Cr Goodbehere rose aDd said he had an amendment to propose. The Mayor ruled Cr Goodbehere out bf order as he had already spoken to the motion. CrJ. C. Thompson said he. would like the matter to remain in abeyance so as to allow of au arrangement lo be made with Mr Palmer. - . .The following is the resolution which had been debated: — Proposed by Cr Lethbridge, seconded by Cr Haybittle, That the matter of the nuisance at Mr Gillett's mill 'be. deferred for a fortnight, -to, be dealt with by the "Inspector of Nuisances in the meantime. — Carried.

Proposed by Cr S. ,J; Thompson; seconded by Cr AY. Watts,- That the request of Mr Carthew re scaffolding, be allowed, subject to the approval of the Clerk of Works ; also, that of Mr Nicholas's re concrete footpath opposite Messrs Pringle Bros.' premises in accordance with the Bye Laws. — Carried. Certain applications to be placed on the ratepayers roll were read, and dealt with in the following resolution : — Proposed by The Mayor, seconded by Cr Lethbridge, That the names of Mrs" Oliver, E. Lyne, •H. Penberthy," Mr Gregory, and Dr Charlton be added to. ' the roll. — Carried. Proposed by Cr J. C. Thompson, seconded by Haybittle, That the Treasurer be instructed to pay the amount claimed by the Auditor, viz., £8 6s Bd.—-Carried. Proposed by Cr J. C. Thompson, seconded by Cr T. B. Chamberlain, That theapplication of Fidler for the appointment of Borough nightman be granted.~Carried. " ' The Mayor said # the question of appointing a Borough valuer would have tobe settled, he moved and Cr S. J. Thompson seconded, That" Mr G. C. Hill be appointed Borough Valuer. — Carried. Cr Haybittle asked what was owing for flax royalty, and the Mayor Btated there was some little hitch. Mr Gillett declined, to accept a certain liability. The Mayor had instructed Mr Cooke, solicitor, to apply for the .money. As soon as a reply from Mr Gillett was received, it would be laid before the Council. - Cr J. C. Thompson said there was a lot of grass growing in the 'pound paddock, which ought to le cut down "or it woidd become dangerous from fire. He made a proposal' to take over/ the paddock from the Council. ?■ Proposed by Cr E. Goodbehere; sec-' onded by Cr Haybittle, That the agreement with Mr J. C. Thompson for lease of his paddock be rescinded from the 15th December, 1889, in accordance with his wish. — Oumi-d. : y and Cooke be appointed Borough solicitors. - The Council went into committee.- On resuming . ' Cr Goodbehere said that he would move an amendment. - The Mayor ruled him out of order. The-motion was then 1 put and carried on division by 5 votes to -4. Proposed by Cr Goodbehere, seconded "by Cr Butherford, That the appointment of Borough solicitors be for twelve months only. ■ " Cr J. C. Thonjpson objected to the resolution whiclf was an insult. By agreement the word "only" was struck out and the resolution passed. ' The Council then adjourned.
