The Fielding Star. TUESDAY, OCTOBER 1, 1889. No. 5 Ward Loan
Most of the ratepayers in the Manchester Road District are aware that it is the intention of the Board to submit loan proposals to the electors in No. 5 ward on the same lines as those already voted for, but which were in validated by a technicality. In order to facilitate the polling Mr Macar thur wrote to the C 1 .nial Treasurer the following memorandum : — " September 10, 1889. " Memorandum for the Colonial Treasurer : — " 1. Subsection 6, clause 37 of The Local Bodies Loans Act, 1886, provides that in a Borough or Town District, and in every road or river district not divided into subdivisions there shall only be one polling booth. "2. Sub-section 7 again provides that in Counties or road and river districts divided into sub-divisions, the poll shall be taken in like manner as at the election of a member of the local authority, i.e., that there may be as many polling booths within such riding or sub-division as the Returning Officer in his discretion may think tit (in this case the Presiding Officer), see Regulation of Local Elections Act, 1876, clause 14, 18 and 22. "3. There is another case which does not appear on the surface to be specifically provided for, viz., that of a poll taken for a special rate within any of such ridings or sub-divisions for a loan for the benefit of t le individual riding or sub-division only. " 4. In this case do the provisions of sub-section 7 apply, or, in other words, is the poll to be taken as in the case of an election of a member of the local authority to represent such riding or sub-division ? "D. H. Macarthur." '• The Treasury New Zealand, Wellington, 26th Sept., 1889. " To D. H. Macarthur, Esq., M.H.R., Feilding|; — " Sir, — I have the honor, by direction of the Colonial Treasurer, to acknowledge the receipt of your letter of the 10th inst., relative to sub-section 7 of Section 37 of " The Local Bodies Loans Act, 1886." " In reply, I am to inform you the Colonial Treasurer is advised that the provisions of the sub-section above-mentioned do apply to cases where a poll is taken for a special rate within a riding or sub-divi-sion of a road district for a loan for the benefit of the individual riding or subdivision. The poll has to be taken as in the case of an election of a member of the local authority. Section 42 of the said Act also governs the case you mention. It is assumed that the Presiding Officer would use his powers under " The Eegulation of Local Elections Act" judiciously, and so as to give effect to the requirements of the particular case. " I have the honor to be, Sir, " Your obedient servant, " Jambs C. Gavin, " Secretary to the Treasury." This will allow the presiding officer to appoint as polling places Mangaoa^, Bunnythorpe and Taonui, thus affording no excuse for any ratepayer neglecting to record his vote.
