Feilding Borough Council
The special and ordinary meetings of the above were held on Thursday evening. Present— The Mayor (Dr Monckton), Crs Rutherford, Goodbehere, Fowles, T. E. Chamberlain. SPECIAL MEETING. The following resolution was proposed "by Or' Fowles, seconded by Cr Rutherford, That sections 22 to 51, both inclusive, of the Rating Act 1882 as amended by the Rating Act 1882, Amendment Act 1883, and the Rating Act ISB2 Amending Act 1885 shall apply to the recovery of all rates now due or hereafter to be made for the purposes of the Borough of Feilding. Cr Goodbehere asked if the Council had .... power -to adopt portions of the Act. The Mayor read the clause from the Amendment Act giving this power to the J* Council. The resolution was then put and carried. ORDINARY MEETIKG. Cr J. C. Thompson entered the Council room and took his seat. The minutes of the previous ordinary -meeting were read and confirmed. CORRESPONDENCE. From the Southland County Council, .•enclosing resolutions re Hospital and Charitable Aid Bill. From Prior and Cooke, re lease of a certain section in Fergusson street by W. JD. Nicholas to Messrs Pringle Bros., and an application from the former to make a right of way for Messrs A. and J. B. Pringle from Fergusson street to Eyre •street, asking the Council to pass a resolution as required by law. From the Poundkeeper, handing over £5 18s 6d proceeds for the month of August. Cr Haybittle remarked the pound was a little gold mine to the Borough. Cr Goodbehere said there were still a -lot of stray cattle about, for all that. From the Secretary of the Feilding "Volunteer Fire Brigade, Mr G. W. Shearer, the Borough to make good the approach from the engine shed to Kimbolton road. From D. H. Macarthur, M.H.R., acknowledging receipt of copies of resolutions ;from the Town Clerk, re Municipal Corporations Act and Hospital and Charitable Aid Bill. From the Premier's office, Wellington, ;also acknowledging receipt of copies of the rsame resolutions as forwarded by the Town Clerk. From W. W. Corpe, in reply to a letter from the Town Clerk, re his wagons, &c, •carrying heavy loads, &c, and offering to ■supply timber to deck the bridge he uses :free of cost, the Borough to find the labor. From G. Gardner, requesting the name j <of W. Penberthy to be put on roll. From John Maysinore, requesting the . name of Dr Charlton to be put on the roll instead of his. [These two letters were held oyer until next meeting.] From the chairman of the Library •Committee, applying for £10 to spend in books," with a memo attached from the Town Clerk re the amount of Library rates collected, asking if it is the wish of the Council the said rates should be paid •over to the Library Committee as collected. From H. Johnston, complaining of •offensive drainage from Messrs P. and J. .Bartholomew's flax mill. From Messrs Prior and Cooke, solicitors, giving an opinion on application for a refund of certain poundage fees. From the Gulcher Electro Lighting ■Company. Reports of Finance Committee, general account, £,16 4s ; charitable aid account, ,£'B lls lid ; and public works, £24 0s Bd, ■were read, and adopted on the motion of Cr Thompson, seconded by Cr Haybittle. Proposed by Cr J. C. Thompson, sec•onded by Cr T. R. Chamberlain, That permission be given to Mr W. D. Nicholas to give right of way to Messrs A. and ■J. B. Pringle, and that Crs Haybittle and Fowles be authorised to sign any paper in reference thereto, and to affix the seal of the Feilding Borough Council to same. — •Carried. The Mayor then explained his reasons for recommending the Council to decline to pay a claim sent in by Dr D. Johnston •on account of attendance and medicine supplied to a Charitable Aid patient. The reasons were that certain items were overcharged. Cr Fowles asked under what authority the liability had been at first incurred. The Town Clerk said a general authority had been given by Mr Goodbehere when he was Mayor. Cr Rutherford asked if the charges were any higher than had before been paid to Dr Johnston. The Town Clerk said accounts containing similar charges for medicine had been already paid by the Council. Cr. Goodbehere said there was nothing before the meeting and they were only wasting time. The Mayor said the account had been referred by the Finance Committee back to the Council, and they had now to consider it. Cr Goodbehere said he thought what the Mayor had already done was quite sufficient, and he proposed a resolution endorsing the Mayor's action, which was carried. Proposed by Cr Goodbehere, seconded by Cr Rutherford, That the ofier of Mr Corpe be accepted, to supply timber for decking the Port street bridge, the Council to find the labor. — Carried. Proposed by Cr J. C. Thompson, seconded by Cr Haybittle, That the letter of Mr Shearer, re request on behalf of the Fire Brigade, be referred to the Public "Works Committee to report thereon at next meeting. — Carried. Proposed by Cr Goodbehere, seconded by the Mayor, That the Gulcher electric correspondence lie on the table. — Carried. Proposed by Cr Fowles, seconded by Cr Chamberlain, That all Library Rates be handed over to the Library Committee as collected without special authority. — - With reference to Mr Hugh Johnston's letter re P. and J. Bartholomew's flax mill drain, the Mayor 6aid Mr John Bartholomew had made all necessary arrangements to remove the cause of complaint. It was then proposed by Cr Goodbehere, seconded by Cr Rutherford, That Mr H. Johnston be informed that the nuisance complained of has now been abated ; and the Public Works Committee be requested to have the drain cleared out. — Carried. Proposed by the Mayor, seconded by Cr Fowles, That the Town Clerk write to Mr F. Maul, informing him that this Council having taken legal advice does not recognise any liability in the matter mentioned in his letter owing to the poundkeeper and ranger at the period in question having beee a contractor and not a servant to the Borough.— Carried. The Council then adjourned.
