The Feilding Star. THURSDAY, AUGUST 15, 1889.
At the R.M. Court yesterday, Mr Cooke made application for costs in a case where judgment was confessed on the day of tho sitting of the Court without notice having been given to the plaintiff in the case, or his solicit tor. The R.M. declined to make any order for costs, following the rule laid down by his predecessor of not allowing solicitor's fees where the amount sued for was under £5. He mentioned that there was great diversity in the practice in different Courts, and it would be a great advantage if there was an universal rule applying to all R.M. Courts in the colony. He further said if the members of the profession, practicing in th-s Courts over which he presided, were to agree on a proposition embracing the question of costs in such cases as those referred to by Mr Cooke, he would give it his best consideration. We understand that the suggestion of Mr Brabant will be adopted, and the members of the legal profession invited to draw up the required proposition.
