Claim £4 16s 4d, To be paid 20s a month, or 6 days imprisonment. Cobbe & Darragh v. Gcb. Moss. — Claim £A 10s 3d. To be paid £2. in one month, and the balance in two months, or six days imprisonment. . . _ S. J. Thompson v. Mrs B. G. Lloyd.— Claim j>9. Mr Cooke (Prior and Cooke) for plaintiff, and Mr A. S. Baker for defendant. This was a claim for value of a cheque which had been lost by Mr Lloyd, and which Mr Thompson had cashed for the finder in good, faith, and. was therefore a bonafide holder.. Constable Meehan produced the cheque 1 which was handed into caurt. ' - • Samuel Jacob Thompson deposed : On April 2he cashed the cheque; ?had no> . knowledge bearer was not the legal holder--' ot the cheque ; the cheque had, been refused payment at the bank ; had applied to Mr Lloyd for the amount, who refused, hence these proceedings. ' Cross-examined* by Mr Baker : Did not know the man who presented it; had given goods and cash for the cheque ; 'itwas customary in business to cash thesecheques; was not aware an information had been laid for the loss of the cheque. Mr Baker addressed the Court. He condemned the practice of storekeepers in cashing cheques without caution. Ha contended Mr Thompson should suiter theloss of the amount, especially as th& cheque was drawn on a branch bank in Palmerston. :■::': Mr Cooke replied to the points of law, and contended that his client had taken every necessary precaution. Mr Baker said the case was. being defended on a matter of prinoiple. He quoted the opinions of Judges of the Supreme Courts on* the reckless cashing; of cheques by storekeepers, and others.
