Fraudulent Bankruptcy

At the Palmorston Police Court yesterday morning, before Messrs W. J. Hirst and G. M. Suelson, J.P.s, Charles Henry was charged that he did, within four mouths of presenting his petition 111 bankruptcy on June 19 last, fraudulently remove a portion of his goods, to the value of £10 and upwards, with intent to defraud his creditors.

Mr Hankms appeared on behalf of the Deputy Official Assignee, Mr G. J. Scott.

Mr Hankms called the. following evidence : —

Sergeant Anderson, of Wanganui, produced receipt dated April 24 signed by accused, which he had received from Constable Meehar. at Feilding, for goods which had been in the custody of the police.

Constable Meeban, of Feilding, on 24th April last, had handed over to accused 3 cases of goods, which had been forwardod from the Wanganui Police Station.

Thomas Wickham and Ernest Brown deposed to carting the goods to the Railway Station.

Frederick Towler ; Railway porter, deposed to having received the cases.

Charles C. Lambert, stationmaster, produced consignment notes signed C. Henry.

Samuel Mills deposed the goods were yalued at between £40 and £50. He helped to put the cases in the carts.

The Clerk of the District Court produced the petition of accused to be adiudged a bankrupt dated June 19.

H. J. Hahday. saddler, Feildiug, deposed he had, instructed by the police, valued the articles at £46.

G. J. Scott, Official Assignee, stated that on June 19 accused filed a petition in bankruptcy, and witness thereupon took possession of the stock-in-trade of the bankrupt in his shop at Feilding. On June 25 took an inventory of the stock. Had found none of the stock in accused's shop which had been delivered by the police to accused. Accused had not accounted for these goods. Had examined accused's books, and found no trace of any of these articles.

This closed the case,

Accused reserved his defence, and was committed for trial at the next sittings of the District Court at Palmerstou. He did not ask for bail,
