This Day. (Before E. Ward, Esqr., E.M.) CIVIL CASES. Kirton & Curtis v. Harrison Davis. —Claim, £1 Is. Verdict for plaintiffs and costs 7s. E. Bume v. Alfred Hannah and G. Olsen.— Claim, £6 10s 3d. Mr Prior [ for plaintiff and Mr Staite for defendants. Richard Bume deposed: He was a butcher, in Kiwitea, and his claim was for meat supplied ; both parties had promised to pay. Cross-examined by Mr Staite: (He produced his book, showing particulars of entries) ; Hannah ordered the meat for Hannah and Ohen ; the latter never ordered any ; the meat was packed up to the camp ; offered to let the parties work it out ; held Ol«en responsible ; had never received a shilling in payment. Re-exn mined: Saw OUen who admitted his indebtedness aud offered to pay 10s a week, Judgment for plaintiff against Olsen with costs 28s. and counsel's fee 21s, to be paid at 10s a week. George Bennett and Richard Ash t. C. Behrent.— Claim £7 18-s Bd. This was a claim for balance of a partnership i account in a contract for scrubbing. G. Bennett, laborer, deposed : Ho saw Behrent about cutting 30 acres of scrub at Halcombe ; met defendant, who told ' him he (defendant) had a contract to cut scrub for Mr Riddiford ; went out and saw the ground; Ash was present, \?ith P. Anderson, witness, :ind Behrent ; the latter said he could not do it. himself, nor could he get any one in Ha'comble to assist him ; aereed to go in on third shares; a small piece had already been done, and 30s was to be allowed for it ; have received £2 8s 6d in cash ; it was distinctly understood that as soon as the scrub was down they were to receive their money ; nothing was said about the burning. Cio<s examined : The contract was made on the ground in the presence of witnesses ; the job was worth £40 Richard Ash gave similar evnler.ee Carl Behrent deposed: H> coirr-u-tei with Mr Riddiford to rut and burn 35 acres for £21 ; started with another ;i»d worked I<H and 16 days «-ncl< ; afterwards employed plaintiffs, and when the cutting was finished they werepnid £2 10s and afterwards £1 more on the undestanding they were to tuke that as a last payment, witness to do the burning, and they would travel for another job. Peter Nelson deposed : Was present when contract was made to cut and burn manuka ; when it was dt ne the money would be paid. D. R Riddiford deposed : Gave a contract to Behrent to cut and burn about 35 acres of manuka for £21 ; had paid £11 on account of the work. Counsel having addressed the Court, Plaintiffs were nonsuited with costs. Tne Court then adjourned.
