'" It will doubtless be ia the recollection of our readers that sonae few months ago an important decision was given by Mr X.< Ward, RvM;/ against Awahou-Pohangina Association in the ease in which a contractor's workman named- Jones had sued the Association for the amount of his wages whilst working on the contract for the facing of the road lines. The case for appeal was stated by the lawyers* but it was sent back, and the E.M. then stated the case. The next heard of it is the following, which .appeared in the New Zealand Times' report of the I proceedings at the Supreme Court :• — "HCGHEYX JONES..-. A contractor partly- performed his contract and then abandoned it. A workman of the. contractor sought to attach the.money supposed to be due. The employer sought-to-sei up certain defences, mcludjng that ihe work was not done. The magistrate refused to hear evidence, on these defences. Honor the chief Justice decided- that the magistrate was wrong, and that he must continue" to r hear • the case. If this be se, it would appear that the Association will win their cape.
