The case for appeal was stated by the lawyers* but it was sent back, and the E.M. then stated the case. The next heard of it is the following, which .appeared in the New Zealand Times' report of the I proceedings at the Supreme Court :• — "HCGHEYX JONES..-. A contractor partly- performed his contract and then abandoned it. A workman of the. contractor sought to attach the.money supposed to be due. The employer sought-to-sei up certain defences, mcludjng that ihe work was not done. The magistrate refused to hear evidence, on these defences. T^he employer appealed. •, Mr> Brown; f or the appellant was stopped. >■ : |b' Tanner for the respondent, Hia. Honor the chief Justice decided- that the magistrate was wrong, and that he must continue" to r hear • the case.
