Kiwitea Boad Board
The ordinary meeting of the aboTo was held on Saturday • last. Prese. t — Messrs Taylor, Williamson, Lucas, Haythorne, aud Bruce. On the motion of Mr Bruce, seconded by Mr Haythorne, Mr Taylor was elected Chairman for the ensuing year. The minutes of the last ordinary monthly meeting were read and confirmed, correspondence. From S. Goodbehere, solicitor to the Board, as follows: — Feilding, May 19, 1888. Gentlemen, — Lyne v. your Board. I have to report that this case, which was tried at Palmerston yesterday,* has resulted in a verdict for your Board with costs, the jury finding that the -amount which your Engineer had certified to be due to the plaintiff Lyne (and which, as I informed your Board in my letter of th» 20th uit., I had paid into Court), was all that, the plaintiff was entitled to. This result may m a ereat measure, if not altoget c , be attiibuted to the very conclusive evidence of the Engineers (Mr F. Owen, Mr J. E. Armstrong, and Mr C. Thorns) whom we called in support of Mr Bray's contention that the deviation from the original contract was in favor of the contractor except as regards the standing : bush, which was rather heavier than on the road as originally laid out, for which' your Engineer had allowed him a sum of £4; this evidence completely overruled that of theEngmeejs Mr Mountfort and Mr Hill, called by the plaintiff, who endeavored to show that the deviation caused an additional expense to the contractor of upwards of £60. In justice, however, to Mr Mountfort and Mr Hill, I may state that it was very evident they were completely misinformed as to tho facts. It is to be hoped that the result of this case wul tend somewhat to stop the constant endeavors which are made to extort damages from Corporate Bodies on frivolous grounds, and although your Board has been put to considerable expense m meeting this unjust claim, I think it will be found that the result has completely justified the expenditure.
S. Goodbehebb. From Henry Stewart, applying for cost of falling roadline along section 17, Pohangina. From the Surveyor-General, stating that instructions had been given to have a road surveyed from the Oroua. river to the Feilding Special Settlement Block.
From E: Watson, re a flow of water on to his section in the Harbor Board Block, and offering to construct a drain remedying same for £\6. From 0. Field, asking for permission to erect a gate across Hayne'et road.
From E. Mudford, re Kimbolton road contract.
From the Chief Surveyor, stating that it was proposed to take a portion of section 296, Kiwitea, for road purposes, under the Public Works Act, and asking the Board to close a portion of the existing road. From the Hospital and Charitable Aid Board, asking fpr the yearly contribution of the Board, which amounts to £9 16s 6d for Hospital, and £13 2a for Charitable Aid payments!. From H 7 Bannister, with tracing of certain roads in the Harbor Board Block.
From the Bey. W. Stewart, drawing the Board's attention to the case of a man namfed Nelson who required an order for the Hospital. From Treasury, notifying payment of the following amounts :— Laan for Pohangina, £3000; deferred thirds, Waituna, £101 6s lid; Government grant Kimbolton road progress payment, £55.
Proposed by Mr Bruce, seconded by Mr Haythorne, That Mr Field be allowed to erect a gate across Hayne's road subject to the approval of the Board's Engineer, and that he put down gravel in front of same. The gate to be removed at any time on application of the Board.— Negatived. Proposed by Mr Lucas, seconded by Mr Williamson, That the offer of Mr Watson to construct a drain for £15 be accepted on condition that it be carried ou. . at Once to the satisfaction of the Engineer, and that Mr Watson indemnify tho Board from any damage that may hereafter occur. — Carried.
Resolved, That application be made for amount of deferred thirds Waituna Block.
Proposed by Mr Taylor, seconded by Mr Williamson, That the necessary steps be taken to close the road as requested by the GoYernihent.--Car-ried.
Proposed by Mr Lucas, seconded by Mr Taylor, That tenders be oalled bynext meeting for Pohangina road formation from near the sohool to section 68 Zig Zag road, formation of whole length, m about mile contracts; Fin. via' road from the end of present formation to Zig Zag road, out of loan. — Carried.
The following tenders wero accepted for various works:— Behrendt, £59 0s 3d, for No. 1 Finnis road; Younger and Laing, 27s per chain, for No. 2 Finnis road; J. H. Ash worth, £135 Bs, for No. I Valley road ; Stretton and Co., £117 17s 6d, for No. 2 Valley road; Whitman and Davis, £99 10s, ;for Taonui road;. Simpson and Larsen, £100 17s 6d> for Pollock's road.
With preference to the finances of Makino ward, Mr Williamson stated that some arrangement should be com© to on the matter, as the ward was only getting deeper into debt. He did not think ihe other. wards were justified in taking over tho, whole of the liabilities, but he was .willing to do something to assist in reducing same. After some desultory discussion it was resolved, That the matter be again held oyer, and that the clerk prepare a statement showing the amount expended on the construction and maintenance of Cheltenham cross road. Acoounts for £316 8s lOd were passed for .pay ment, and the meeting A journed. ■■■"■
