She pleaded not guilty. t Mary Ana Fagan deposed : She j was in business in Feilding, boot sel- * ling; there was a fire on Tuesday r morning, and some of her goods were 1 put out on the roadside; identified 9 the boots produced ; never sold a pair 1 to prisoner, or authorised her to take f them. } Prisoner said she bad never j seen Mrs Fagan before, to her kmow- , ledge. Richardson made a deolarai tion and deposed : He was a settler r in Feilding ; was at the fire on Tues--1 day; assisted to remove goods from 1 the burning store ; saw the Constable { take the boots from the woman, who t turned her back, and walked away ; , could not swear, but prisoner resembled the woman. Constable Meehan deposed : He was on duty at the fire in Manchester street looking after the goods; saw accused put her hands as if she had something under her cloak; opened > her cloak, aad the boots fell to the 1 ground ; told her to go home. . By the Court: Held her until the ; boots fell to the ground ' r did not see prisoner putting wings into a box. ; Prisoner — on oath — stated she went > to the fire ; expected to see her hus- , band; when she saw the careless manner in which the boots and things were thrown about, went to assist in putting them into a box ; the clothing she bad on was scanty, and in covering herself with her ulster the boots became covered up; had been fourteen years in Feilding, and had sever before been accused of theft. By the Police: The goods were thrown on the side of the street, and ; people were walking on them ; would swear the ulster she then had on was the one she wore at the fire. Mrs Fagan, recalled, said she did not observe the prisoner; was in too excited a state to notice anything in particular. Constable Meehan said prisoners' eldest son was over 14 years, and her... youngest was about 2 yean. Mr Marshall, dairyman, said the family was suffering from, poverty.
