— ; — . W[ The following, report of the case Miller V. Corporation of Dunedin ought to be a guide as well as a warning to every Borough Council in the colony. The plaintiff sued for £500 damages, for injury receired through the blasting at Dowling street. Mr Justice Williams, ia summing up, said that* the Corporations were responsible, because the operations were conducted on ope of the. streets of the city. The streets were vested in the Corporation j who controled them. It was one, of the powers of tho Corporation to bring the streets to their proper level, and these had been conducted partly for that purpose, and the persons at work in the street had been appointed by the Corporation. Under these circumstances, the Government finding the money for the works did not shift the responsibility from the ' Corporation. A verdict was returned! for £50, and the Judge certified for costs on the lowest scale.
