Cribb.— Claim £9 2s2d. , r Same r H. Hughes.— Claim £!6'9s. Judgment for plaintiff in eachcase. C. E. Thome t H. Wagataff.-r-Glarai £15, being balance of rt debfrfoif £20 due to plaintiff for instruction^ in cheese and butter making. : '1 Mr Prior for plaintiff and Mr Staite for defendant Mr Staite said that he held receipt* for £5 and £15. His .client was unable to be present, but his client assured him the two amounts had been paid. As it was for him td prove payment he would like plaintiff to go into the witness box. C. E. Thome was about to be sworn when His Worship raised a point of jurisdiction. The affidavit made by the plaintiff was signed before ft J-P-t which was not sufficient. The point was an important one in case of ulterior proceedings being taken. Only Clerks of the Court have power to take affidavits, and Resident Mftgis* trates in epen court under the Act of 1872. The point had been brought up in other courts and and settled. It was a case therefore in whicfif the summons was not properly issued/ Mr Staite applied for costs. Mr Ward stated he had not pewer to allow them.

Judgment for plaintiff for amount claimed, £20, costs 15s, and counseled fee 21s was also entered.
