Mr Chapman opposed the discharge on behalf of some six or seven creditors, on the ground that the debtor had produced a fictitious "balance-sheet to aome of Ac creditors, and had thus obtained credit. Assumingthe balancesheet referred to was .true, there was property : valued at £1:400 unaccounted for. He was also said to be guilty of a breach.' of faith in not filing his petiion as Sgreed upon at a meeting of his creditors. Examined by Mr Chapman, the debtor admitted producing a •balance-sheet to Messrs Turhbutt, Smith and 00. That showed a balance of £368 14a 4d in bis favor. He obtained goods from the firm on credit. The debtor was examined at some length as to the difference between his statement to j the .Assignee, and the balance-sheet above referred to. Mr Shaw having put . some questions to the debtor, attempting to show that the goods supplied by Turabull, Smith and Co. had been forced upon him, Mr Lang, accountant' 'for Messrs Turnbull, Smith and Co., said the balance-sheet was- stated by the debtor to be a true statement of his actual position, and that upon the 'strength of that statement goods were supplied. His Honor did not think that the evidence against the^bankrupt was sufficiently specific. At.tthe same time he did not think that' the books had been kept with proper- exactness. He would grant a discharge, to take effect in six months.
