Eiwitea Road Board

The adjourned meeting was held on Saturday last. Present — Wardens Taylor (chairman), Williamson, and Tyremaiu ' COREESFOinJEJroE. Letter was read. from MrGood.behere, solicitor, enclosing a copy of judgement in case against Wanganui Harbor Board in favor of the hitter Board, and advising that the rate be relevied, also enclosing copies of ieaolutions which he advised being adopted; District Surveyor asking |f the Board would undertake inspection of road contracts let by the Survey" Department, and .on what terms ;.,— Chairman stated that he had author- ~ ised the Clerk to inform Mr Dundas that the Board's Engineer would unt dertake the work at a commission -of £5 ; Mr G. Bull with reference ' to the amount promised by him for the construction of the Cheltenham Cross Road. Mr Bull explained that with reference to aresolutionpasaedthreatening him with legal -proceedings for the amount he, promised, he had come up on two occasions when there, should have been meetings of the Board, but on each occasion he had his journey for nothing, there being' l n6 meeting.' He had left /word with Mr Bray that if he would have ready the Board* acknowledgement, and promise to repay, at the time agreed, he would give him a cheque at any time when 1 passing. He further stated that he had deposited his cheque for £140 with Messrs Prior and Sandilands with instructions to hand over in due course. Mr Prior waited on the Board on behalf of Mr Bull, when a proposition made by the Board Jthat he should pay the interest on the amount of £140.at 8 per cent., for 12 months in lieu of the amount itself was accepted by Mr Prior on Mr Bull's behalf. Proposed by Warden Taylor, an'd^ seconded by Warden 'Tjxeman; That the resolution passed at the meeting of the 29th of August that; notice should be given of the Board's intention of striking a rate of fd in the '£ % • ;on the rateable properties in the, itea Eoad Board District be rescinded. Carried. ;: 1 ■ ' II ■ Warden Taylor proposed, and Warden Williamson seconded, That mas» much as the rate of |d in the £, made by this Board on the 18th of August, 1884, has by order or judgement of the Supreme Court of N.Z. been declared void and invalid for not stating in the rate-book or in the resolution making the rate that it was a general irate and made under the 43rd section of The Counties Amendment Act, 18S2, it be an instruction to the clerk to give public notice of the intention; of this Board under or by virtue of * : the powers or authority rested in it by the 43rd and the 14th sections of the Counties Act, 1876, Amendment Act, 1 882 tir either of them, at a meeting' to be held on Saturday, the 24th October next, to make or strike a general rate of £d in the £ upon the rateable value.: of the rateable property as appearing in the valuation roll of the Kiwitea' Road District for the time being in " force for the year ended on the 31st , March, 1885 ; such rate to be payable in one sum on the 26th October; and that the following memorandum be the public notification of the intention to strike the above-mentioned rate, that is to say — — : ; - • Memorandum: The rate collector, will be instructed in collecting, the , above-mentioned rate to give credit to - all those ' ratepayers who have paid the invalid rate made on the 18th August, 1884, above referred "to, f or \ the sums which have been respectively paid by them in respect of such rate. —Carried.
