8m, — With reference to the resolution of the Council passed last evening, withdrawing the advertisement for the election of a new Mayor, I think it desirable that the public should be informed of the exact position of the case, and with this view I now enclose a letter which I wrote to you in reply to your article on the subject, appearing in your issue of the 27th ultimo, but which I hesitated to send in consequence of a telegram which the Town Clerk had, in the meantime, received from Mr Travers, of Wellington, stating that in his opinion -the Mayor's office had become vacant. The action of the Council was taken in consequence of a letter received by the Town Clerk from the Mayor,, coinciding with my views (and which I understand it is your intention to publish), and I quite concurred in the Council's action, because I felt that Mr Travers, in giving ' his opinion, had not been furnished with the full particulars of the case. In addition to the points to which the Mayor and myself have drawn attention, I may add that it was fully understood when Mr Macarthur agreed to be nominated as Mayor, at the public meeting in the Town Hall, that he would be absent from the Council meetings during the Parliamentary session, and at the first meeting of the Council held after his departure for Wellington the question of the Mayor's absence was broached, and the Council fully understood and recognised the necessity of his absence, thus in reality granting him leave of absence and complying with the requirements of the Act, which does not direct that leave of absence shall be in writing, or any resolution to be passed on the subject. — I am, &c,
