The Blackmore Case
j —^ — . — -*. _ ; The ease, of Blackmore v Feilding Borough Conircil being a claim for £200 'for alleged damage sustained by plaintiff by the late flood, was brought on at the .District Court, Palmerston, yesterday, before Judge Kawsoh. Mr Staite- with Mr Warburton conducted the case for the plaintiff, and Mr llankins with Mr Goodbehero for the defence. The jury were— Messrs T. S. Hoc, J.B.Hamilton, Haybittle,- and Hosking. The plaintiff examined by Mr Staite, described the damage done to his property and the expense he had been put to by the War* Wick street bridge being carried away and washed on to his place. He was cross- ; examined by Mr Hankins and re-exam-inod by Mr Staito, Messrs Gichard, j Hose, and McNeil wore also examined. The plaintiff alleged neglocfc on the part of the Borough authorities inasmuch as the bridge was insecure before the flood took place, and no attempt was made to secure it when it was found to be washing away, the cnusequen.ee being that the bridge blocked up the stream on his property and caused the said damage. The eridence far the defeuce showed that there was no neglect on the part of the Borough, and that when it was found the brigde was going it was fastened with, ropes, that the flood was of unprecedented violence, and its effects beyond the control of the defeudants. The trial lasted till about 4 o'clock' in the afternoon and resulted in the plaintiff being nonsuited with costs..
