The Feilding Star. THURSDAY, OCTOBER 9, 1884. Road Boards Act

The Hon. Mr Buckley, the Colonial Secretary, has introduced a Bill, entitled the Boad Boards Act 1882 Amendment, and is intended to become a part of the Boad Boards Act, 1882. It provides tlfat when any local body fails to pay any debt due to any person or corporation, the creditor may apply ex parte by petition in a summary way to a Judge of the Supreme Court, for relief under this Act, who may, if satisfied with the justness of the claim, appoint a Receiver, who shall exercise all the powers of a duly constituted Council or Board of any local body in respect to the making, levying, and recovery of all rates, current or in arrears. The negleot or omission to elect a Council or Board shall not affect the powers lof the Receiver. Any rate made or levied by the Receiver shall be valid, | notwithstanding that at the time of the making or levying of any rate ! there were no members of the local body elected and holding office. All moneys paid to the Receiver shall be applied to the payment of costs and charges of the Receiver-, and his reasonable and necessary expenses; in payment of all debts due by the local body at the date of the appointment of the Receiver- The residue, after payment of the above, to the local body. The Receiver shall account for all such moneys as the judge directs. All the provisions contained in the Rating Aot, 1882, relating to valuation rolls, rates, and rate books, and all other provisions of the Act, shall apply to the Receiver. When all debts due at the time of the appointment are paid, or if a Judge of the Supreme Court make an order to that effect, the powers of the Receiver shall cease, and he shall forthwith pay any moneys in his hands to the local body, who shall again be capable of exercising the powers of which the Receiver had deprived them. The last clause of the Act provides that every Road Board shall have power to expend a portion of its revenue in the construction and maintenance of works for the purpose of irrigation or water supply, and in acquiring land for such purpose.
