- ♦ — In the Supreme Court on Thursday at Wellington, tho case of Scaliy v Wel-lington-Manawatu Railway Company was heard. The action was brought to recover £300. amount of deposit forwarded by him with a tender for the construction of a portion of the Wellington - Manawatu Tailway line. It was also sought to recover another sum of £500, being the estimated amount of profits which tho plaintiff considered ho had lost through tho cancellation of his tender, Mr Scaliy tendered for the formation of a portion of the Wellington- Manawatu hue, and enclosed a cheque for £300. He subsequently received a letter from the Company, directed to him at Makatoto, informing him that his tender had been accepted. The letter was written by Mr James Wallace, secretary to theCompany, ; who stated that it would be requisit© for the tenderer, who had mentioned Mr DScaliy and Mr Saunders as his sureties, to find another surety in place of the latter gentleman. His Honor summed up instructing the jury to find for plaintiff with interest from the 7th August. After half an hour's deliberation, the j ury found as directed by the Judge, and also damages for £500. Several points of law have been reserved for argument in banco.
