Feilding Borough Council

♦ ; An ordinary meeting of the Council was held in the Council Chamber, on Thursday evening last. Present—The Mayor (in the chair), Crs Worsfold, Fowles, Carthew, Goodbehere, Rutherford, liichardson, Loudon, Thompson, and Higgin. The minutes of the previous ordinary meeting were read and confirmed. The Mayor reported that he had written to the Commissioner of Insurauce re the loan, but had not received a reply. The report of the Finance Committee was read, an t on the motion ot Cr Rutherford, seconded by Cr Loudon, was adopted. The report of the Public Works Committee was read. Cr Thompson jraioved, and Cr Richardson seconded, That the report of the Public Works ommittee be adopted. Cr Loudon said he would like to know the probable cost of the work. In response to the Mayor, Cr Higgin gave some explanation of the work required, but thought; the Engineer would be better able than himself to give an idea of the cost. The Engineer, in answer to the Mayor* gave a rough estimate of the cost of the work. Cr Richardson thought' it would cost double what Mr Hill had mentioned. After further conversation the. motion, for the adoption of the report was put to the Council and carried.' (The report appears in another column.) The monthly report of the Borough Poundkeeper was read and adopted. The report showed the number of animals impounded to be 20 head, the amount received £1 19s ld, and the amount to hand over to the Council, £1. A communication from the Borough Auditors was read. Resolved that the sum of £5 be transferred from the ordinary account for petty cash. The report of the Inspector of Nuisances re the drainage of the properties in 'Manchester Street was read. The report, whioh was a very lengthy one, and cootamed matters of . a purely personal character, concluded by die Inspector stating that owing to his former instructions to Messrs Gichard, J. C Thompson, and Rutherford not being oarried out he had taken legal proceedings against them, and he begged the Council to support him in the action. A letter was read from the Town • lerk of Wanganui, giving notice of the meeting of the Hospital Committee, and asking the Towu Clerk to inform the delegate Iti was agreed by the Conneil that no» delegate be sent. The following tenders for works were then opened :— Railway Line lioad— Heanett and Spooner, £158 16s ; Fearon and Norman, £139.; Thomas Smith. £144; Younger and Laing, £159 19s ; J. Powell, £168 Os 9d; J. Belfit, £155. Campbell, East,, and Derbj StreetsYounger and Lain?, £148. 8s ; F and W. Bassett, £139 2s; E. Jackman. £139 19s; Thomas- Smith, £149; R~ Bowler, £147 10s i J. Powell, £123 2* ; J*. Belfit, £124 ; Heanett and Spooner, £153 Bs. On t'*e motion of Cr Thompson, seconded by Cr Richardson, the tender of Messrs Fearon and Norman for Railway Street was accepted. . On the motion of Cr Rutherford, seconded by Cr Loudon, the tender oi J. Belfit for Campbell, East, and Derby Streets was accepted Cr Goodbehere called attention to the report of the Inspector of Nuisances, and said he considered he had acted very precipitately in taking the course he had in issuing summonses te the persons concerned without having given then due notice of his action. He read extracts irpm the Municipal Corporations Act, shewing the powers vested in an Inspector of Nuisances, and gave as his opinion that the Inspector had grea- ly exceeded his duties, and had taken action for which be was not warranted, and wbich ho should not have done without the authority of the Council, iie thenmoved the following resolution: That it be an instruction of the Inspector of Nuisances forthwith to withdraw the summonses which he has, without tl • authority of this Council, issued again.' t Messrs Gichard, Thompson, and Rutherford, and not to issue any summons in future without the express authority of the Council. ( 'r Loudon seconded the resolution. Cr Richardson thought the Inspector was fully warranted in taking the aotion he had, and was empowered to do so by the bye-laws. He advised that nothing be done in the matter, but that the summonses be left to take their course. . The Mayor considered that the Inspector had committed an error ot judgment, but had acted to the best of his knowledge, and with good intention. . He (the Mayor) acknowledged that he had hurriedly signed the summonses, but still bethought that it would be better to have them withdrawn, and have legal . advice taken on the matter. „ Cr- Higgin endorsed the remarks of Cr Goodbehere with reference to ibe precipitate action of the Inspector, and urged the advisableness of the summonses being withdrawn. Cr Richardson moved, and Cr Fowles seconded, Thai the summonses be not withdrawn, but be allowed to take their course. '• During the discusiion Cr Thompson made two attempts to address the. Council, but being one of the persons concerned, the Mayor ruled that his doing so would be out of* order.; . , The amendment was put and negatived. mover be authorised to take legal advice on behalf of the Council with reference to the filling up of the old water course crossing Manchester street, aud the powers of the Council with reference to the filling up of the holes or gullies ou sections 231, 232, 233, belonging to Messrs Gichard, Thompson and Butherford.— Carried. Cr Fowles moved, an! Cr Worsfold seconded, That plans and specifications be prepared for the formation of Railway Line from Russell street to Eyre street. — Carried. It was moved by Cr Loudon, seconded by Cr Goodbehere, That the salary of the Town Clerk be increased to £150 per annum from Ist January, 1884. 1f The Mayor and one or two councillors spoke in complimentary terms with reference to the Town <■ lerk, and thought _. he thoroughly deserved an advance of salary, especially as his duties of late had largely increased. The resolution was put and carried unanimously. Cr Thompson moved, and Cr Richardson seconded, That the Mayor be requested to communicate with the Government re the formation and metalling of the Railway Line between Eyre street and Kimbolton road.— Carried. Resolved, on the motion of Cr Worsfold, seconded by Cr Fowles, That the Council meet again on the 21st of Feb., at the usual time and place. The Mayor said he had communicated with the Oroua County Council and the Manchester Road Board re the Borough taking over the cemetery, but the matter was still in abeyance, and the cemetery committee were not yet prepared with a definite report. This closed the business, and the Council then adjourned.
