A Singular Action.

An action of a rather singular nature came before his Honour the Chief Justice when the Wellington and Manawatu Railway Company was proceeded against by one Madigan, the lessee of the tollgate at Kaiwarria, who sought to recover the sum of £500 as damages, for alleged loss sustained by him through the acts of the Company's employes. The declaration plaintiff set forth that, owing to the operations carried on the hillside by the contractori, the road on which was situated the tollgate was rendered dangerous to passers-by, and a great deal of vehicle traffic was consequently lost, the result being a decrease in the amount of revenue wbich it was stated he derived from the tollgate. Mr FitzGerald was for the plaintiff and Mr Travers for the defendants. After a considerable amount of argument, a case was stated as to whether the company was liable for the acts of its contractors. —Post.
