Mr Prior appeared for platatift. ; Lawtoft deposed that he had paid £10 on account ot this debt ; had land and catde, but disposed of them at the sate* at Awahurii had no cattle ) have two horsey had cropped Ms land this had not sold his corn* had sold at two sales at Aw&huri ; paid Fraaer nothing out of the money; the cattle were sold for £20 \ got the money beforehand \ had five acres of com, wheat* and maize not thrashed \ expected to receive money from llammond> of Rangittkei> next < month ; his share amounted to £65* The case was adjourned to next Court day, March 14th. - • Samuels r Mcßeth.— <oU«n £30. Th* defendants were charged with a breach of the Railway Bye-laws on January 30 by getting on a train while in motion* T. Brebner deposed he wai station* master t knew the defendants \ at the 7.50 train to Fox ton. after the train had moved some 8 or 4 yards, the defendant* scrambled on to the train the best way they could; one got on the platform and tlic otiier on the buffers of a carriage \ was certain the train was moving t stopped the train, and Instructed the) guard to take their names. Cross-examined t Did not see Mr Bill before the train was started. Fv Towler, porter, deposed t He saw the defendants get out of the train and stand on the platform j after the traift started one jumped on the platform and the other on the buffers \ was certain the train was moving; saw the defendants) talking on the platform., —Hay ward, guard, saw the defendants at Halcombej at Feildfag, he did not notice they Were in the train ; got propef signals to start the train, and rode along 3 or 4 yards looking to see that no on* got into the train ( suddenly the train was stopped and the stationmastef ordered him to take their names* D. Hv Macarthur deposed i He remem* bered the evening in question; could not identify the defendants ; flaw two person* rush to the train after it was started; saw a sort of scuffle, and the train stopped | saw two persons getting on the train ( the platform Was ter/ crowded. P% Bartholomew deposed! He remem* bered the 30th Jan. $ did not know the defendants) saw a man get on to «> carriage after the train xtarted ; »atr the station-master stop the train | the plat* form was crowded. Constable Price deposed I Wat on duty at the station that night, and fair Mr Bill talking to Mr Fit«herbert| the train was started ) saw Mr Bill rush on | saw the statiomnaster stop the train; defendant asked if he Was stationmaster| heard Mr Bill siy he would report the stationmaster. Mr Bill addressed the Bench, and said that the witnesses had stated the case rery fairly. He was then sWorn, and deposed t His name was Bill) was J.P. for the County of Stafford; alighted from the train to hand over some deed* to Halcombe and Sherwill'g clerk; did so, and posted himself so that lie might get on the train before it started j heard a bell rung ; as he saw no other passen* gers get on the train he Waited for* further signal) when he tried to get on to the carriage he found the platform crowded, aod a person struggling out; he got on the guard's van but could not get in ( he jumped off the guard's van and then on to the carriage; when the train was stopped he told the stationmaster he would report him to his stt* perior officer in Wellington j he did so. Cross-examined t Was not speaking to Mr Fitaherbert. Norman Fiteherbert, farmer at Rangi* tikei, deposed t Saw defendants get out at Feildiug j heard the bell ring J got in after the train started ; very few second* were allowed for the passengers to get in the train) the carriage was full; considered that any irregularity was caused by the little time allowed; did not linger about the station needlessly. Croßs-examinedt When the train start* ed the carriage was full t the time at* lowed was only half a minute after the bell was rung. Ralph Fitfcherbert deposed i He ira* agent for the Bank of New Zealand; wai on the platform of a first class carriage \ could not get off as persons entering pre* I rented him. Mr Beach deposed t He was traveling) got off lo speak to some people \ got oa between the carriages ; could not get ifl owing to the number of people on the carriage platform. The Bench thought the guard should see that people Were not allowed te) stand on the platform. The Bench believed Mr Brebner had only done hi* duty in bringing the ease against defend* ants, The Bench dismissed the case, after which the Court adjourned'
