TUESDAY, SEPTEMBER 25. (Before Mr J. R. Bartholomew, S.M.) DEFAULT CASES. Judgment, with costs, was. awarded plaintiffs in the following cases:—Reddells Ltd. v. Harold J. Bain, £ll 5s sd, goods supplied; Victor Nelson Ltd. v. A. Dickison, £3 15s, goods supplied; J. Harvey and Co, Ltd. v. Robert Isbister (Wellington), £1 18s lOd, goods supplied; D.I.C. Ltd. v. Gwen Rouxelle (Dunbaek), £9 16s 4d, goods supplied; W. H. Brain well v. George Coxon, £6 ss, goods supplied; Walker and Laing v. Edward William Fulton, £23 7s 3d. goods supplied and money lent. TRUCK OVER BANK. As the result of an accident on a bend above Concord, on the Main South road, involving a lorry crashing into a gully, William Joseph Bryant, a contractor (Mr E. J. Anderson), proceeded against William George Collie (Mr J. C. Mowat) claiming £9O 16s 6d representing damage to the lorry. On January 4 last Robert Walter Rear, an employee of the plaintiff, was driving the truck towards Green Island. The defendant was driving his car in the opposite direction. Because of the way defendant drove, it was alleged, Rcay had to swerve violently and on to a bank running down off the road. It was alleged that the defendant was negligent in that he failed to keep a proper look-out, failed to keep as close as possible to his correct side of the road, and he overtook or attempted to pass a car proceeding in the same direction when he did not have a clear view of the road and the traffic on it for at least 300 ft. There was no collision between the truck and the car. . , , - Both parties were hoard, and the case was continued this afternoon.
