SPINSTER’S WILL CHALLENGED THE MEDICAL EVIDENCE [Pkk United Press Association.] CHRISTCHURCH, October 8. Medical evidence as to the testamentary capacity of the testator wasgiven in the Supreme Court to-day when the hearing of the Elizabeth Smith nill case was continued. Plaintiffs, Olive Judge and Ivy Cookson, both ot Christchurch, sought revocation or probate of the will of Elizabeth Smith, and the Guardian Trust and Executors Company Ltd. defended the action. Dr John Russell, deputy-director ot Mental Hospitals, giving evidence this morning, said that, so far as this case was concerned, in February ot this year all the papers in connection "’dm an application under the Act for aged and infirm persons’ protection weie placed before him. In his repprt he said that from a medical point ot view, he considered Miss feimtli diet not have a disposing mind in Deccuiber, 1933, and it could bo proved that she did not have a disposing mind sis months later.
