AWARD ON POLICY SET ASIDE
[Per United Press Association.] CHRISTCHURCH,. September 23. When a car. owned .by Ambrose Reeves Harris, a company director, was damaged he claimed the full amount of the policy of £3OO from the National Insurance Company of New Zealand. The claim was , disputed, and went to arbitration, the umpire awarding Harris £276, the car to be handed to the company. In the Supreme Court to-day the company asked that the award be set aside. His Honour ordered that the award given at arbitration should be set aside. “It is quite clear,” he said, “ that one of the arbitrators, Stacey, assumed his function to be that of advocate for the side appointing him. The other arbitrator. Kennett, did not, and the arbitration then proceeded against the rules necessary _to obtain substantial justice.” _ Eventually, His Honour continued, the award was that of an umpire who proceeded on irregular evidence and viewed the car without a knowledge of the company. The umpire, following Stacey’s irregularity, improperly proceeded to his award, which should be set aside. Costs amounting to £ls were alowed against Harris.
